Is it legal for Erdogan to run in the Turkish elections?

Many Turkish political leaders and lawyers believe that Erdogan has no right to run for a third term, but government-affiliated lawyers have a different view.

According to Pak Sahafat News Agency International Group, with each passing day, the debate over the possibility of holding early elections in Turkey is heating up. Many government and ruling party officials, including Turkish President Recep Tayyip Erdogan and the leader of the Justice and Development Party, have stated that there is no reason to hold elections and that everyone must be patient until the sixth month of 2023.

But the opposition believes that the government itself knows that the current economic crisis has called into question the legitimacy of the party and the government, and that another victory should show the opposition that the people still hope for the party and not for the party and other currents.

Many Turkish political leaders and lawyers believe that Erdogan has no right to run for a third term, but government-affiliated lawyers have a different view.

What does Erdogan’s partner say?

The government of Baghcheli, the leader of the far-right National Movement party, has been one of Erdogan’s main opponents for many years, shooting his shadow. Because he believed that the AKP’s flexibility with the Kurds and the PKK would lead Turkey to insecurity and disintegration. But after the 2014 elections, the AKP reached a point where it could not form a government on its own.

That’s why he joined the National Movement Party, and from that day until now, the page has been turned and Bagçli is a supporter of Erdogan. Contrary to the traditional tradition of the coalition governments, he did not take Erdogan, the deputy and the ministry, but he is involved in all important government decisions, and it is said that Erdogan would not drink water without coordination with Baghcheli. The Baghcheli government is now seeking to remove legal obstacles to Erdogan’s re-nomination.

Baghchi said among his party leaders: “It seems that there are some legal obstacles to the re-election of the president. But we will do our best to make the necessary legal arrangements for the president to be elected for at least three terms, and we will achieve this. No one should fish in muddy water; no one should pursue raw dreams.”

I write an article, the problem is solved

Professor Mustafa Shentop, Speaker of the Turkish Parliament and one of the most important figures in the Justice and Development Party, has always been a close confidant of Erdogan and is now set to become President. Mustafa Shentup has a different reading and believes that because the first term of Erdogan’s presidency was before the beginning of the presidency, it should not be included in the law prohibiting three candidacies!

Asked about Erdogan’s candidacy, Shantop said: “There is no legal discussion on this issue and we are basically not prohibited. The first round of his presidential election will not be counted. In fact, the upcoming elections are the second time that Mr. Erdogan has been nominated. The Constitutional Commission has conducted the necessary investigations in this regard, but it has not been raised in public yet. I have done a university study in the legal field and I have a detailed article that I will publish soon. But I can say that there is no legal problem in this regard, and the current marginal debate is due to lack of information.

Will the ruling party oust Erdogan?

In recent weeks, as the possibility of early Turkish elections has risen, many analysts have come to the conclusion that Akparti does not want to field Erdogan as the main candidate in the upcoming elections.

In the past few years, most of the party’s capable politicians, whose qualities were such as freedom, boldness in criticizing and courage to stand up to Erdogan’s decisions, have either got off the party train themselves or, according to Ahmet Davutoglu, been pushed out.

People like Abdullah Gol, Ahmet Davuto Oghlu, Blunt Arnç, Bashir Atalay, Taner Yildz, Ali Babacan, Abdul Latif Shener and many others.

As a result, those who remain are often people whose job is not to reform Erdogan’s decisions and actions, but to consistently endorse him, and that is what has hurt the AKP.

These people see the personality, power and popularity of their party in Erdogan and do not allow any alternative to talk. However, behind the scenes, there are people who say: The “boss” has won all the elections so far. Do not let his name be registered as a leader who did not vote and was removed from power after losing the next elections. Let someone else come to the fore and let the defeat remain in the minds of the people in the name of someone other than the “boss”.

A marginal debate over whether or not to ban Erdogan’s candidacy has sparked controversy, with many critics and opponents arguing that the issue is futile for two reasons: The first is that the Justice and Development Party, in partnership with the National Movement Party, holds the majority of seats in parliament and enacts any law it wants, and there is no need for it. Second, even if the existing barriers are removed and Erdogan returns to the race, he will not be able to win the popular vote.

But there are also cautious critics and opponents who say that unless the task of the opposition coalition is clarified and their final candidate is announced, it is not possible to speak conclusively about the possibility of defeating Erdogan.
